eDiscovery AI Release Notes – September 10, 2024
The September eDiscovery AI Release introduces all new Privilege review.
Privilege Review
By selecting the Privilege tab in the Send to eDiscovery AI mass action users will have a separate workflow for privilege review. Attorney Client Communication and Work Product are predefined, and users also have the option to enter custom privilege types and draft a prompt describing that additional type of privilege.
Attorney Client Communication – a predefined type of privilege analysis. Users simply need to check this box and eDiscovery AI will review the documents for attorney client communication.
Work Product - a predefined type of privilege analysis. Users simply need to check this box and eDiscovery AI will review the documents for attorney work product.
Privilege List – A field where users input a list of attorney names which will help eDiscovery AI identify individuals or domains that presumptively create attorney client privilege. Use plain language for these names without any special formatting or proximity syntax.
Safe Domains - Users input a list of email domains that are considered internal for the purposes of privilege analysis and inclusion of these domains on any email would NOT break privilege.
Attorney List Field – A user created, long text field where the names of all attorneys found in a document will be listed by eDiscovery AI.
Log Entry Field – A user created, long text field where eDiscovery will draft a privilege log entry
Elements Field – A user created, long text field where individual elements contributing to privilege will be listed. This field will be populated by eDiscovery AI only when a document would be considered potentially privileged, and will help highlight where various factors indicating privilege are strong or deficient, requiring further attorney review.
